Plea-Bargaining

The plea-bargaining is a procedure whereby the defendant agrees to plead guilty in exchange for a reduction in the number of charges or a promise by the prosecution not to seek the maximum penalty allowed by the Law. 

The plea-bargaining agreement must specify the promised punishment to be sought by the prosecution, conditions for release if the suspect is under arrest or detention and the conditions for restitutions to the victim if this is part of the agreement.

These practice directions govern the general procedure of plea-bargaining by judges, prosecutors, the defendants, defense counsels and victims of criminal offenses.
